General Terms and Conditions — Road to the Ring

§1 Contracting Party and Scope

(1) These General Terms and Conditions (hereinafter "Terms") apply to all bookings of Road to the Ring packages (hereinafter "RTR Packages") with:

Hereinafter "the Company", "we" or "us".

(2) These Terms apply exclusively to the RTR Packages (Discovery Week, Fight Ready, Fight Pro). Separate terms apply to other offerings (Train & Stay, Fight Night Tickets, Venom Gym Camps for external gyms).

(3) By completing a booking, you expressly accept these Terms. Deviating conditions only become part of the contract if the Company agrees to them in writing.


§2 Conclusion of Contract

(1) The presentation of the RTR Packages on venom-mt.com does not constitute a binding offer but rather an invitation to submit a booking request (invitatio ad offerendum).

(2) By submitting the booking via the website, you make a binding offer.

(3) Standard accommodation (gym bungalow): The contract is concluded upon receipt of the automated booking confirmation by e-mail following successful payment.

(4) Comfort accommodation (resort): The contract is concluded only upon receipt of the Company's express confirmation of availability followed by your full payment. Until then, your booking is considered a non-binding request.

(5) By making the booking, you confirm that you are at least 18 years of age and physically fit to undertake intensive martial-arts training.


§3 Scope of Services

(1) The specific scope of services arises from the description of the selected tier (Discovery Week, Fight Ready, Fight Pro) at the time of booking and from the booking confirmation.

(2) Discovery Week: Pure training camp without competition participation. Following completion, you will receive a single-use discount code of 10 % applicable to a future booking of Fight Ready or Fight Pro. This code is valid for six months from the date of arrival, personal to the e-mail address used for the Discovery booking, non-transferable and not redeemable for cash.

(3) Fight Ready and Fight Pro: Include participation in a competition during the camp stay (preferably at the monthly Venom Fight Night on the 28th, alternatively at another stadium on Koh Phangan). Participation is subject to clearance by the Head Coach (see §7).

(4) Travel to Koh Phangan: To be organised by you. The scope of services includes only a single pickup at Phangan Pier (Thong Sala) at a pre-arranged time, as well as a single return transfer to the pier on the day of departure.

(5) Training equipment (gloves, shin guards, headgear) may be provided free of charge. Personal protective equipment such as mouthguard and groin guard is to be brought by you. The use of the training equipment is at your own responsibility.

(6) Health disclosure: Before commencing training, you shall disclose to the on-site coaching team any pre-existing conditions, injuries or health-related limitations that are relevant for the safe performance of training or any competition participation. On this basis, the Head Coach may restrict the scope of training or competition participation (see §7).

(7) Double occupancy (Twin): The selected tier can be booked for double occupancy. If both persons participate in the training programme, both must meet the requirements under §2(3). If only one person participates in the training programme and the second person travels as a companion (non-training companion), the following conditions apply:

a) Included in the companion's scope of services: accommodation in the double room, pickup and return transfer at Phangan Pier, admission to the monthly Venom Fight Night at the gym (if taking place during the stay), use of the fitness area (strength training, weights).

b) Not included: participation in training sessions (classes, padwork, clinch, sparring), competition participation, admission to competitions at external venues.

c) The companion must be at least 18 years of age and accepts these Terms by virtue of the booking; the booking person warrants this and is the sole point of contact of the Company. The booking is treated as a single unit; cancellation, rebooking, and transfer always relate to the booking as a whole.

(8) The Company reserves the right, on operational grounds (illness of trainers, weather, force majeure), to adjust the content of individual training elements or reschedule them, provided that the overall scope is essentially preserved.


§4 Prices and Payment Terms

(1) All prices are stated in Thai Baht (THB) including the statutory value-added tax of 7 %.

(2) Payment methods and payment processing are handled via the methods offered during the booking process (in particular credit card, Apple Pay, Google Pay, PromptPay) through the payment service provider Stripe.

(3) Standard: The full booking amount is due immediately upon completion of the booking.

(4) Comfort: Upon confirmation of availability by the Company, you will receive a payment link. The amount must be paid within 7 days of dispatch; failing this, the booking confirmation lapses.

(5) Currency exchange rate risks (THB ↔ EUR/CHF and others) are borne by you.

(6) Any bank charges or foreign transaction fees levied by your card-issuing bank are not included in the price.


§5 Cancellation, Rebooking and Transfer

(1) Cancellations, rebookings and transfers must be made in writing by e-mail to hello@venom-mt.com. Decisive is the receipt by the Company.

(2) Voluntary cooling-off period (7 days): Within 7 days from the booking confirmation, you may cancel the booking without giving reasons and receive the full booking price refunded. The cooling-off period ends no later than 30 days prior to the date of arrival; for bookings made fewer than 30 days prior to arrival, no cooling-off period applies and the cancellation schedule under paragraph (3) applies immediately. There is no statutory right of withdrawal for this service; the 7-day period is granted by the Company on a voluntary basis.

(3) Cancellation after the cooling-off period:

This schedule reflects the fact that places freed up at short notice cannot be reallocated.

(4) Free rebooking: Up to 14 days prior to arrival, you may reschedule the booking once, free of charge, to a later date within 12 months of the original date of arrival, subject to availability on the new desired date. Further rebooking or cancellation of the rescheduled booking is no longer possible; the entitlement lapses if the new date is not taken.

(5) Transfer to another person: Up to 7 days prior to arrival, you may transfer your booking to another person free of charge. For transfers at a later point (until and including the day of arrival), a transfer fee of 1,500 THB applies. In any case, the new person must meet all requirements (minimum age, physical fitness), accept the Terms in writing, and sign a declaration of awareness of risks (in particular regarding competition participation) at check-in.

(6) Discount-code bookings (Discovery → Fight Ready / Fight Pro): If a booking paid with a discount code is cancelled, the code lapses irretrievably. In the event of rebooking or transfer, the discount remains.

(7) Refunds are made, as a rule, via the same payment method as the original payment. If a chargeback through the original payment provider is no longer technically possible (for example, because the payment has already been finally paid out to the Company), the refund is made by bank transfer; any fees arising in this context (in particular for international transfers) are deducted from the refund amount.


§6 Injury, Illness and Camp Interruption

(1) Injury or illness occurring prior to arrival: Upon presentation of a meaningful medical certificate, rebooking to a later date within 12 months may, at the Company's reasonable discretion, be granted. There is no entitlement to a refund.

(2) Injury or illness occurring during the camp: No refund is granted for days not used. Upon request, an extension of the stay against separate surcharge (accommodation and meals) is possible, subject to capacity.

(3) Early departure for personal reasons (homesickness, lack of motivation, other private grounds) does not entitle you to a refund.

(4) Taking out travel cancellation insurance as well as international health and accident insurance with explicit martial-arts coverage lies within your own responsibility (see §8) and is strongly recommended.


§7 Competition Participation (Fight Ready and Fight Pro)

(1) Participation in the competition takes place at your own responsibility and at your own risk ("Fight at your own risk"). The competition takes place in Thailand at an event licensed by the Sports Authority of Thailand under Section 26 of the Boxing Sports Act B.E. 2542; the regulations of the Sports Authority of Thailand and of the Board of Boxing Sport apply. In Muay Thai, fighters compete at their own risk in accordance with long-standing industry practice. You confirm that you are aware of the risks associated with Muay Thai competitions — in particular injury, including serious injury — and expressly accept those risks.

(2) The decision regarding fitness to compete rests exclusively with the Head Coach (Kru Pok). His decision is final and not subject to challenge. If fitness to compete is denied, no fight takes place; no claim for refund of the booking price or any part thereof arises.

(3) The competition takes place preferably as part of the monthly Venom Fight Night on the 28th of each month. The Company reserves the right to host the competition alternatively at another stadium on Koh Phangan if this is operationally sensible or required (for example matchmaking, weight class, opponent availability). There is no obligation to host the competition at a particular stadium.

(4) First-aid medical care by a doctor or qualified personnel at the venue is included for the competition day.

(5) Taking out suitable international health and accident insurance with explicit martial-arts coverage is strongly recommended for competition participation (see §8).


§8 Insurance and Personal Responsibility

(1) Prior to your arrival, you are strongly advised to take out the following insurance policies:

a) Travel cancellation insurance — for the event that you are unable to travel due to illness, injury or other unforeseeable circumstances and the cancellation schedule under §5 limits the refund.

b) International health and accident insurance with explicit martial-arts coverage — for medical treatment during your stay as well as for injuries during training and competition.

There is no obligation to take out any of the aforementioned policies; all financial consequences of inadequate or missing insurance are borne by you.

(2) Training at the gym as well as all related activities (including but not limited to padwork, clinch, sparring, running, strength training, ice bath) take place at your own risk.

(3) All activities outside the scheduled training times (water sports, scooter/moped riding, diving, hiking, attendance at parties, etc.) take place exclusively at your own responsibility and are not part of the contractual services.


§9 Conduct and House Rules

(1) During your stay, the rules of the gym and the accommodation apply. You undertake to act respectfully towards trainers, fellow guests, local staff, and Thai culture.

(2) The Company reserves the right to exclude you from further participation in the camp without refund of the booking price in case of serious violations. Serious violations include, in particular:

  • physical violence outside the controlled training and competition setting,
  • consumption, possession or trafficking of illegal substances on the premises,
  • theft or wilful damage to property,
  • discriminatory, racist, extremist conduct or other conduct violating the dignity of others,
  • repeated or serious disregard of the trainers' safety instructions,
  • repeated disregard of the house rules.

(3) Violations of applicable Thai law (in particular drug law and criminal law) lead to immediate exclusion and will, where appropriate, be reported to the Thai authorities.


§10 Image and Film Rights

(1) In the course of training and competition operations, images and video recordings are taken which the Company may use for marketing purposes (website, social media, promotional material).

(2) By making the booking, you agree to such use without deriving any claims therefrom (in particular no claims for remuneration).

(3) You may object to the use of your identifiable recordings at any time, without specific form, by e-mail to hello@venom-mt.com; from receipt of the objection, the Company will not use the recordings concerned further and will remove them from ongoing publications insofar as this is possible with reasonable effort and technically feasible.

(4) The optional "Road to the Ring Video" add-on is a separate, chargeable service and is subject to separate terms agreed at the time of booking.


§11 Data Protection

The Company's Privacy Policy applies to the processing of personal data. It forms part of these Terms.


§12 Liability

(1) The Company has unlimited liability for damages arising from injury to life, body or health that are based on an intentional or grossly negligent breach of duty by the Company, its legal representatives, or its vicarious agents.

(2) For other damages, the Company is liable only in cases of intent or gross negligence and in cases of breach of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely). In the latter case, liability is limited to the damage that is typical and foreseeable for this type of contract.

(3) Liability for loss, theft or damage to valuables, cash, or travel documents brought along is excluded to the extent legally permissible.

(4) The Company is not liable for damages arising from voluntary participation in activities outside the agreed training and competition operations (see §8(3)).

(5) Mandatory liability under Thai product liability law and under any applicable mandatory consumer-protection law of your country of residence remains unaffected.

(6) Personal responsibility in training and competition operations: Participation in Muay Thai training (including padwork, clinch, sparring) as well as in competitions takes place at your own responsibility and at your own risk. Injuries arising in the course of sport-appropriate training and competition operations — in particular through training partners, sparring partners, or opponents — are part of the typical risk of the sport and do not give rise to any liability claim against the Company. The liability of the Company under paragraphs (1) and (2) remains unaffected.


§13 Force Majeure

(1) If performance of the contract becomes impossible or substantially hindered by force majeure (in particular natural disasters, pandemics, official orders, war, violent civil unrest), the Company may postpone or cancel the stay.

(2) In case of cancellation initiated by the Company, you will be refunded the booking price, less any demonstrably incurred non-refundable third-party costs. Further claims, in particular for reimbursement of travel or flight costs, are excluded.


§14 Applicable Law and Jurisdiction

(1) These Terms and the entire contract between you and the Company are governed by Thai law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) The exclusive place of jurisdiction for all disputes arising out of or in connection with this agreement is Surat Thani, Thailand.

(3) If you are a consumer with habitual residence in a member state of the European Union or in Switzerland, you retain the mandatory consumer-protection rights of your country of residence, in particular rights of jurisdiction and mandatory protective provisions.


§15 Final Provisions

(1) Contract language: These Terms are provided in German and English. In the event of any discrepancy between the language versions, the English version prevails.

(2) Severability: Should individual provisions of these Terms be or become wholly or partly invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic intent of the invalid provision.

(3) Amendments: The Company reserves the right to amend these Terms with effect for future bookings. For bookings already concluded, the version valid at the time of booking applies.

(4) Form requirement: No oral side agreements exist. Amendments and supplements to this agreement must be made in text form (e.g., e-mail).
